This is a presidential proclamation (Proclamation 10888), signed January 20, 2025, by President Donald J. Trump. It declares that an “invasion” is ongoing at the southern U.S. border and directs the federal government to block and remove people who cross there illegally. It relies on the President’s authority under the Constitution and immigration statutes, chiefly sections 212(f) and 215(a) of the Immigration and Nationality Act (INA).
It suspends the entry of foreign nationals deemed “engaged in the invasion” across the southern border, effective the date of the order, and keeps that suspension in place until the President personally declares the invasion over (no fixed end date). It bars those individuals from invoking INA provisions that would let them stay, explicitly naming asylum (section 208 / 8 U.S.C. 1158). It also suspends entry of anyone who does not first give federal officials enough medical, criminal-history, and background information to satisfy the INA’s health, safety, and security screening (sections 212(a)(1)–(3)). It directs the Secretary of Homeland Security—working with the Secretary of State and the Attorney General—to “repel, repatriate, or remove” such individuals. The document cites figures such as at least 8 million people encountered at the southern border over the prior four years as the basis for the declaration.
Foreign nationals who cross the southern border illegally on or after the order’s date are the direct subjects—their entry is suspended and their access to asylum and other stay-in-country provisions is restricted. The Department of Homeland Security, the State Department, and the Justice Department are directed to carry it out. The proclamation states it creates no legal rights or benefits enforceable against the U.S. government and must be implemented consistent with existing law and available funding.
