What it is

This is a HUD administrative action called a “delay of effective date,” published in the Federal Register on April 29, 2026. It does not change the words of any regulation; instead it postpones when two specific pieces of a larger 2025 HOME program rule take legal effect. HUD directs that these two provisions be delayed indefinitely rather than starting on their previously scheduled date.

What it changes

Most of HUD’s January 6, 2025 “HOME Final Rule” already took effect on April 20, 2025, but two provisions had been repeatedly pushed back and were set to start April 30, 2026. As of April 29, 2026, HUD delays both of them indefinitely, meaning there is no longer any set start date. The two frozen provisions are the change to 24 CFR 92.250 on green building standards and the change to 24 CFR 92.253 on tenant protections and tenant selection. HUD says it is holding these back so it can gather more public comment, and that it will “imminently” publish a proposed rule; only after reviewing comments on that proposed rule will HUD decide the final fate of these two provisions.

Who is affected

The HOME Investment Partnerships Program funds affordable housing through state and local governments and their partner organizations, so those grantees, along with affordable-housing developers and property owners, are the ones who must follow (or, for now, need not follow) these rules. Because the delayed items cover green building standards and tenant protections/selection, the current rules on those topics stay in place and the newer 2025 requirements do not yet apply. Tenants who would have gained the new protections, and builders who would have faced the new building standards, are unaffected by those specific changes until HUD completes its further rulemaking.
