This is a presidential executive order (Executive Order 14361, signed November 20, 2025), issued under emergency economic and trade powers. It adjusts an earlier order (Executive Order 14323 of July 30, 2025) that had placed extra tariffs on certain goods from Brazil. It directs that the list of exempted products be updated and that U.S. tariff schedules be changed accordingly.
Under the earlier July 2025 order, certain Brazilian articles carried an added 40 percent import duty (on top of normal duties), with some products already exempted in a list called Annex I. This new order removes certain agricultural products from that added 40 percent duty by replacing Annex I with an updated version, and it modifies the Harmonized Tariff Schedule of the United States as detailed in Annex II. The changes apply to goods entered or withdrawn for consumption on or after 12:01 a.m. Eastern Standard Time on November 13, 2025. Because the effective date is before the order’s signing, duties already collected on the now-exempt goods are to be refunded through U.S. Customs and Border Protection’s standard refund procedures. The order states this follows a October 6, 2025 call between the U.S. President and Brazilian President Lula and “initial progress” in ongoing negotiations.
Importers and businesses bringing the affected Brazilian agricultural products into the United States are directly affected, since those goods no longer carry the extra 40 percent duty and prior payments may be refunded. U.S. federal agencies—led by the Secretary of State, working with Treasury, Commerce, Homeland Security, the U.S. Trade Representative, and others—are tasked with carrying out and monitoring the changes. The order creates no legal rights or benefits enforceable against the U.S. government by any party.
